Conditions of participation newsletter competition

Participation in the competition organized by Next Chapter GmbH, Mühlenweg 4, D-35510 Butzbach, Germany (hereinafter referred to as "Next Chapter") is only possible subject to these terms and conditions. By participating in the competition, you accept the following terms and conditions. The competition is not affiliated with META and is not sponsored, supported, or organized by META in any way.

1. Participation requirements

All natural persons with legal capacity who are at least 18 years old at the time of participation and who have their permanent residence in Germany, Austria, or Switzerland (hereinafter "participants") are eligible to participate. In Austria, only consumers are eligible to participate. Employees of Next Chapter GmbH and their relatives are excluded from participation.

Each participant may only take part in the competition once.

To participate you must be a Bookiepad newsletter subscriber.

Participation in the competition is not linked to the purchase of products or the use of other services from Next Chapter GmbH.

The deadline for participation is 27.08.2024, 11:59 PM. Timely subscription to the Bookiepad newsletter is crucial for timely participation.

The legal process is excluded.

2. Early termination and exclusion from the competition

Next Chapter GmbH reserves the right to cancel the competition in whole or in part. This applies in particular if the competition cannot run as planned for any reason, such as computer viruses, software and/or hardware errors, and/or other technical and/or legal reasons that affect the administration, security, integrity, and/or regular and proper conduct of the competition.

Next Chapter GmbH also reserves the right to exclude persons who violate these conditions of participation or who use unauthorized aids or otherwise gain advantages through manipulation.

3. Profit

The winner will be decided by drawing lots. The prize cannot be transferred to a third party. Cash payment in the event of a win is not possible.

The winners will be contacted via the email address they provided.

4. Liability

Claims for damages in connection with the conduct of the competition are excluded unless otherwise stated below. The above exclusion of liability also applies to the legal representatives and vicarious agents of Next Chapter GmbH, should you assert claims against them. Excluded from the above exclusion of liability are claims for damages due to injury to life, body, or health, as well as claims for damages resulting from the breach of essential contractual obligations. Essential contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract. Also excluded from this disclaimer is liability for damages resulting from an intentional or grossly negligent breach of duty by Next Chapter GmbH, nor for damages resulting from the impairment of the availability of the competition website due to technical malfunctions and force majeure events beyond its control, as well as attacks by third parties against the competition website. However, Next Chapter GmbH will make every effort to ensure the reliability and functionality of the competition website. Furthermore, Next Chapter GmbH does not guarantee that the competition website will function properly on your device.

5. Data protection

As part of your participation in this competition, Next Chapter GmbH will process your personal data in accordance with the Data protection information about the competition / our data protection information (9. Presence on social media channels) including information about you. Next Chapter GmbH processes your data exclusively in accordance with the applicable data protection requirements of the EU General Data Protection Regulation 2016/679 and other applicable data protection regulations. Next Chapter GmbH ensures the protection of your personal data, in particular through technical and organizational security measures that comply with current security standards.

Next Chapter GmbH processes and stores your data exclusively for the purpose of processing the competition contract with you in accordance with Art. 6 Para. 1 S1 lit. b) GDPR.

To process the competition, data processing is based on Art. 6 (1) S. 1 lit. b) GDPR

6. Place of jurisdiction / applicable law

In the event of disputes, German law shall apply exclusively. If the participant is a consumer, this choice of law shall apply only to the extent that it does not deprive the customer of the protection afforded by mandatory statutory provisions or case law of the country in which the customer has his or her domicile or habitual residence. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is excluded.

The place of jurisdiction is the registered office of Next Chapter GmbH, provided that the participant is a merchant.

If the participant does not have a general place of jurisdiction in Germany or moves his or her place of residence abroad after participation, the registered office of Bookiepad GmbH will also be agreed as the place of jurisdiction.

Data protection information for participation in the newsletter competition

As part of your participation in the competition of Next Chapter GmbH, Mühlenweg 4, D-35510 Butzbach, Germany, (hereinafter "Next Chapter" or "we") Next Chapter GmbH also processes information about you. We process your data exclusively in accordance with the applicable data protection requirements of the EU General Data Protection Regulation 2016/679 ("GDPR”), the Federal Data Protection Act (“BDSG") and other applicable data protection regulations. We guarantee the protection of your personal data, in particular through technical and organizational security measures that comply with current security standards.

1. Who is responsible for processing my data?

We are responsible for the processing of your personal data in the context of your participation in the competition under data protection law. We will process your personal data in this context for the purposes stated in this privacy policy.

2. What data does Next Chapter GmbH process about me?

Personal data means any information relating to an identified or identifiable natural person (hereinafter referred to as "DataThis includes data that you must provide to us in order to participate in the competition, as otherwise we cannot conduct the competition (name and address in the event of a win). Additionally, if you win, you can provide us with your customer number. The latter data is not mandatory for participation in the competition.

When processing your data, we will not subject you to a decision based solely on automated processing that has legal consequences for you or significantly affects you in a similar way. We do not process any of your special categories of personal data within the meaning of Art. 9 GDPR.

3. For what purposes does Next Chapter GmbH process my data?

We process the data you provide to us exclusively for purposes permitted by the GDPR. This applies in particular to the implementation of contracts concluded with you, i.e., primarily for the implementation and processing of the competition.

Furthermore, we are also required to process your personal data for the purposes of fulfilling legal obligations and for the establishment, exercise, or defense of legal claims. This includes, for example, storing data in backup media, for example, to implement legal data security requirements and our legitimate interests in ensuring a stable IT landscape.

4. On what legal basis does Next Chapter GmbH process my data?

We only process your data if a legal provision permits this. Depending on the purpose of the processing, we may process your data on a different legal basis.

·       Competition: For the implementation and processing of the competition, we process your data to fulfill the competition contract with you in accordance with Art. 6 Para. 1 S1 lit. b) GDPR.

·       Fulfillment of legal obligations: Insofar as we process data to fulfill legal obligations, this processing is based on Art. 6 (1) (c) GDPR.

·       Legal claims: Insofar as we process your data to assert, exercise or defend legal claims, this processing is based on our legitimate interests pursuant to Art. 6 (1) S1 lit. f) GDPR.

5. How long does Next Chapter GmbH keep my data?

In accordance with data protection requirements, we will only retain your data for as long as necessary for the respective purposes described. This means that we will delete your competition data after the expiry of the statutory limitation periods for any claims, including those of third parties, in connection with the competition and the end of the statutory retention periods. The retention and documentation periods specified therein under commercial and tax law extend to up to ten years beyond the end of the contractual relationship or the pre-contractual legal relationship. Furthermore, special legal regulations may also require a longer retention period, such as the preservation of evidence within the framework of the statutory limitation periods of up to 30 years.

6. How does Next Chapter GmbH protect my data?

The security of your data is of utmost importance to us. Therefore, we store and process your data in compliance with the security requirements of such processing under Art. 32 GDPR. To this end, we have developed extensive technical and organizational security measures that comply with internationally recognized standards and that we continuously review.

7. With whom does Next Chapter GmbH share my data?

We will only share your stored data if we are legally obligated to do so in accordance with applicable data protection regulations (e.g., to authorities). However, we are supported in conducting the competition and organizing Next Chapter GmbH's advertising and opinion research measures (e.g., the newsletter) by affiliated companies and various service providers who may process your data on our behalf exclusively for Next Chapter GmbH. We also share your data with other Next Chapter GmbH companies for internal administrative purposes. We do not share your data with third parties beyond this.

8. Does Next Chapter GmbH transfer my data to third countries?

We may also transfer your data to Next Chapter GmbH. The EU Commission has determined in an adequacy decision that Switzerland has an adequate level of data protection. Accordingly, we have not taken any additional security measures for data transfer to Switzerland. We do not otherwise transfer your data to any countries outside the EU or the European Economic Area.

This can be done in accordance with Art. 17 GDPR may be the case if - the data are no longer required for the purposes for which they were collected or otherwise processed; - you withdraw your consent, which is the basis for the data processing, and there is no other legal basis for the processing; - you object to the processing of your data and there are no overriding legitimate reasons for the processing, or you object to data processing for direct marketing purposes; - the data were processed unlawfully; and unless the processing is necessary - to ensure compliance with a legal obligation that requires us to process your data, in particular with regard to statutory retention periods; - to assert, exercise or defend legal claims.

·       Right to restriction of processing (Article 18 GDPR)You can request that we restrict the processing of your data if - you contest the accuracy of the data for the period we need to verify the accuracy of the data; - the processing is unlawful and you refuse to delete your data and instead request that its use be restricted; - we no longer need your data, but you need it to assert, exercise or defend legal claims; - you have objected to the processing pending the verification whether our legitimate grounds outweigh yours.

·       Right to data portability (Article 20 GDPR): Upon your request, we will provide you with your data in a portable format so that you can transfer it to another controller.

·       Right to object (Article 21 GDPR)You may object to the processing of your data at any time for reasons related to your particular situation, provided that the data processing is based on your consent. In this case, we will no longer process your data. This does not apply if we can demonstrate compelling legitimate grounds for the processing that override your interests or if we need your data to assert, exercise, or defend legal claims.

9.2 Deadlines for fulfilling data subject rights

We generally endeavor to respond to all requests promptly. However, this period necessary to fulfill your rights may be extended in individual cases for reasons related to the specific data subject's rights or the complexity of your request.

9.3 Restriction of information when fulfilling data subject rights

In certain situations, we may not be able to provide you with all of your data due to legal requirements. If we have to refuse your request in such a case, we will inform you of the reasons for the refusal at the same time.

9.4 Complaints to supervisory authorities

We take your concerns and rights very seriously. However, if you believe that we have not adequately addressed your complaints or concerns, you have the right to lodge a complaint with a competent data protection authority.
